New guidelines on how to determine the origin of goods
On April 3th, 2018, the Ministry of Industry and Commerce issued Circular 05/2018 / TT-BCT on the origin of goods.Circular 05/2018 / TT-BCT takes effect from the date of signing.
Accordingly, the general principle for determining the origin of goods is originating in the country, group of countries, or territories where the final production process is carried out, which substantially changes the goods.
Specifically, the determination of origin of goods will base on the rules of origin of the preferential goods and non-preferential goods specified in Articles 5 and 6 of this Circular.
In addition, traders requesting C / O shall declare or commit the origin of export goods to meet the preferential origin criteria or non-preferential origin criteria according to forms attached to Appendix II , III, IV, V, VI, VII, VIII and IX of this Circular.
In cases where traders requesting C / O are not the producers, they shall have to request the manufacturers to declare and commit according to the mentioned forms.
